Welcome to St. Louis Cabinet Warehouse. These Terms of Use (“Terms”) are a binding agreement between you and St. Louis Cabinet Warehouse (“we,” “us,” or “our”) governing your access to and use of our website at stlcabinetwarehouse.com (the “Site”) and the services, forms, quotes, and communications we provide through it. By accessing or using the Site, requesting a quote, placing an order, or submitting your information through any of our forms, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, please do not use the Site.

1. Who We Are & Eligibility

St. Louis Cabinet Warehouse supplies kitchen cabinets, bathroom vanities, and custom cabinetry to contractors, builders, and homeowners in the Saint Louis, Missouri area. The Site is intended for users who are at least 18 years old. By using the Site, you represent that you are at least 18 and have the legal capacity to enter into these Terms. If you use the Site on behalf of a business, you represent that you are authorized to bind that business to these Terms.

2. Use of the Site

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for its intended purposes: browsing our products, requesting quotes, placing orders, and communicating with us. You agree not to:

  • Use the Site in any way that violates applicable federal, state, or local law
  • Submit false, misleading, or fraudulent information, including contact information or phone numbers that do not belong to you
  • Attempt to gain unauthorized access to any portion of the Site, other users' information, or our systems
  • Interfere with or disrupt the Site, its servers, or its security features, or introduce viruses or other harmful code
  • Scrape, harvest, or collect information from the Site by automated means without our written permission
  • Copy, reproduce, modify, distribute, or create derivative works from the Site or its content except as these Terms allow

3. Products, Quotes & Pricing

Product descriptions, images, 3D models, dimensions, finishes, and availability shown on the Site are provided for general reference and may vary from the products delivered. Colors and finishes may render differently depending on your display.

  • Quotes are not offers. A quote we prepare for you is an estimate based on the information you provide and is subject to change until we confirm your order. Quotes may expire and may be withdrawn or revised at any time before order confirmation.
  • Pricing and errors. Prices, promotions, and availability are subject to change without notice. We reserve the right to correct pricing or product errors on the Site or in a quote, and to cancel any order arising from such an error, even after confirmation, with a full refund of any amounts paid for the cancelled order.
  • Orders. Your order is an offer to purchase. An order is accepted when we confirm it in writing. Additional terms presented with your quote, order confirmation, or invoice apply to that transaction and control over these Terms if they conflict.
  • Payment. Payments are processed securely by our third-party payment processor. You represent that you are authorized to use the payment method you provide. Applicable sales tax is calculated and added based on the shipping or project address you provide.

4. SMS/Text Messaging Program Terms

St. Louis Cabinet Warehouse offers an SMS/text messaging program for customers and prospective customers who opt in. These program terms apply to all text messages we send.

  • Program description: By submitting your phone number through a form on the Site — including our contact form and product quote request forms — you consent to receive recurring SMS/text messages from St. Louis Cabinet Warehouse related to your inquiry, quotes, orders, appointment reminders, customer care, and marketing or promotional offers. Messages may be sent using automated technology.
  • Consent is not a condition of purchase. You can buy from us without agreeing to receive marketing text messages.
  • Message frequency: Message frequency varies based on your inquiry and your interactions with us.
  • Message and data rates may apply. Check with your mobile carrier for details about your messaging plan.
  • Opt out: Reply STOP to any message to cancel at any time. After you send STOP, we will send one final confirmation message and you will no longer receive SMS messages from us. You can also opt out using our online opt-out form. To rejoin, submit your information again or reply START.

  • Carriers: Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and is not guaranteed.
  • Your number: You represent that the phone number you provide belongs to you, and you agree to notify us promptly if you change or deactivate it.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with, or sold to, any third party. For details on how we handle your information, see our Privacy Policy.

5. Email & Phone Communications

By submitting your contact information through the Site, you also consent to receive marketing, promotional, and informational communications from us by email and phone call, as described in our Privacy Policy. Every marketing email we send includes an unsubscribe link, and you may opt out of emails, calls, and texts in one place using our online opt-out form. Opting out of marketing does not prevent us from sending transactional or service messages related to your quotes, orders, or account.

6. Privacy & Your Information

Our Privacy Policy describes what information we collect and how we use and protect it. We do not sell your personal information, and we do not partner with or provide your personal information to third-party companies for data exchange, data sharing, or marketing purposes of any kind. Information is shared only with the service providers who operate the Site and deliver our communications and payments on our behalf, as described in the Privacy Policy.

7. Intellectual Property

The Site and all of its content — including text, graphics, logos, images, product photography, 3D models, page designs, and software — are owned by St. Louis Cabinet Warehouse or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may view and print pages from the Site for your personal or internal business use in connection with a purchase or inquiry. Any other use, including commercial reproduction or redistribution of Site content, requires our prior written permission.

10. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES OF ANY KIND WITH RESPECT TO THE SITE, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. THIS SECTION APPLIES TO THE SITE ITSELF AND DOES NOT LIMIT ANY WRITTEN PRODUCT WARRANTY WE PROVIDE WITH YOUR PURCHASE OR ANY WARRANTY THAT CANNOT BE DISCLAIMED UNDER MISSOURI LAW.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ST. LOUIS CABINET WAREHOUSE AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, AND OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF YOUR USE OF THE SITE WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER MISSOURI LAW, INCLUDING ANY NON-WAIVABLE RIGHTS YOU MAY HAVE UNDER THE MISSOURI MERCHANDISING PRACTICES ACT.

12. Indemnification

You agree to indemnify and hold harmless St. Louis Cabinet Warehouse and its owners, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the Site, or information you submit — including claims arising from your providing a phone number that does not belong to you.

13. Governing Law & Venue

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Missouri, without regard to its conflict-of-law rules. You agree that any legal action arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in St. Louis County or the City of St. Louis, Missouri, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from bringing an eligible claim in small claims court.

14. Termination

We may suspend or terminate your access to the Site at any time, without notice, if we reasonably believe you have violated these Terms or applicable law. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Material changes to the SMS/text messaging program terms will be communicated as required by law. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

16. Severability & Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy and any transaction-specific terms presented with a quote, order confirmation, or invoice, are the entire agreement between you and us regarding the Site. Our failure to enforce any provision is not a waiver of our right to enforce it later.
